This Privacy Policy applies to the Site and all products and services offered or mentioned by Nobel Globe SRL and its Affiliates (“Nobel” “we”, “us”, “our”) through our Site (“Affiliate” means an entity that owns or controls, is owned or controlled by or is or under common control or ownership with Nobel or control of more than 50% of the voting rights in an entity, or any other significant percent as defined by the law governing the respective entity’s place of incorporation, where “control” is defined as the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of an entity, whether through ownership of voting securities, by contract or otherwise).

Nobel means Nobel Globe SRL, with its registered address at Bucharest, 11 Dinu Vintila Street, 2nd District, 10th Floor, Office no 1, Romania and its Affiliates, as the case.

Nobel and/or its Affiliates are the companies that are recruiting for the job vacancy you have applied for. Nobel will process your personal information as described in this Privacy Policy and will be responsible for complying with applicable data protection laws.

When you apply for a job at Nobel, we will ask you to provide us with personal information about yourself so we can evaluate your application. If this information is not provided, our ability to consider you as a candidate may be limited. You may also provide us with your personal information that we have not specifically requested (for example, your CV may contain information about your hobbies and social preferences).

All information is provided on a voluntarily basis and you determine the extent of information that you provide to Nobel.

Nobel commits to ensure the protection, confidentiality and security of your personal data, which constitute an essential element of our relationship, in compliance with (EU) Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of physical persons with regard to the processing of personal data and the free movement of such data (“GDPR”) and any other relevant regulations. From the GDPR perspective, we are committed to increase the security and credibility of all services.

Nobel is committed to respecting your privacy and to complying with applicable data privacy laws (including GDPR). Software on your device may access your information. WHAT IS PERSONAL DATA?

Personal data is any information that relates to an identified or identifiable living individual. Different pieces of information, which when collected together can lead to the identification of a particular person, also constitute personal data. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as – name, email address or location, and also online identifiers like IP address, various types of website cookies and other device identifiers. Personal data that has been rendered anonymous in such a way that the individual is not or no longer identifiable is no longer considered personal data. For data to be truly anonymized, the anonymization must be irreversible.

 

TYPES OF INFORMATION WE COLLECT

This Privacy Policy covers the information you share with us and/or which may be acquired or produced during the application or recruitment process including:

  • Your name, address, email address, telephone number and other contact information;
  • Your resume or CV, cover letter, previous and/or relevant work experience or other experience, education (educational background including degrees, certificates, transcripts), credit history and/or criminal background screenings (where relevant to your application and permitted under applicable law), transcripts, or other information you provide to us in support of an application and/or the application and recruitment process;
  • Information from interviews and phone-screenings you may have, if any;
  • Details of the type of employment you are or may be looking for, current and/or desired salary (tax information, benefits, expenses, company allowances, stock and equity grants) and other terms relating to compensation and benefits packages, willingness to relocate, or other job preferences, your employment background, including position, work experience, employment references;
  • Details of how you heard about the position you are applying for;
  • Any sensitive and/or demographic information obtained during the application or recruitment process;
  • Reference information and/or information received from background checks (where applicable), including information provided by third parties;
  • Information relating to any previous applications you may have made to Nobel and/or any previous employment history with Nobel;
  • Information about your educational and professional background from publicly available sources, including online, that we believe is relevant to your application or a potential future application;
  • Information related to any assessment you may take as part of the interview screening process;
  • IT Information– such as certain technical information from you about your visit to our Site using “cookies” and other similar technologies;
  • Any other information in your application that you choose to share with us- such as personal preferences, hobbies, social preferences, etc.

We process your data in order to provide the best possible employment opportunities for you. Depending on the relevant circumstances and the various applicable legal or contractual requirements, we may process some or all of the categories of personal data in connection with your employment.

The development of the working relationship between you and us may include:

  • all the information you provide us in order to occupy a job, according to our job offer and / or at your choice, respectively: contact details, identity data, your employment history, existing data in the driving license, where necessary according to Nobel policies, medical information required for employment according to law, data on your education, other data included in your CV that you have sent us;
  • all information we obtain from third parties for your employment;
  • all information that we may be asked to do or that we are allowed to process in accordance with applicable law (for example: information necessary to monitor equal opportunities);
  • other information you choose to send us;
  • other information that the person who recommended you chooses to tell us about you;
  • certain additional information – required by applicable legislation, if applicable; and
  • the data of use of our Sites, in accordance with the cookie settings in your browser.

 

SENSITIVE PERSONAL INFORMATION

Nobel does usually not request or require sensitive personal information regarding religion, health, sexual orientation or political affiliation in connection with your application. If you have a disability and would like for us to consider an accommodation, you may provide that information during the recruitment process.

However, for the purposes of your application this information is voluntary. If you provide us with this information, it will not be considered in the hiring or selection process. To the extent that you provide us with sensitive personal information (race, gender, ethnicity, political opinions or beliefs, membership of a trade union or political party, physical or mental health information, sexual orientation or information related to criminal convictions or offences), you expressly authorize Nobel to handle such information in accordance with this Privacy Policy.

 

INFORMATION FROM OTHER THIRD PARTIES

From time to time, we may obtain information about you from public sources or third parties. For example, we may conduct background screenings through a third-party service provider and verify information that you have in your application that relates to your past education, employment, credit and/or criminal history, as allowed by applicable law. You may also choose to provide us with access to certain personal information stored by third parties such as job-related social media sites. By authorizing Nobel to have access to this information, you agree that Nobel may collect, store and use this information in accordance with this Privacy Policy. We may also obtain and share information through our affiliated companies and group of businesses.

 

HOW NOBEL USES YOUR PERSONAL INFORMATION?

PURPOSES OF YOUR PERSONAL DATA PROCESSING

Your information will be used by Nobel for the purposes of carrying out its application and recruitment process which includes:

  1. Recruitment, selection, evaluation and appointment of job candidates (temporary or permanent) for the job you have applied for and for subsequent job opportunities.
  2. General HR administration and management (in case you become a Nobel employee).
  3. Carrying out satisfaction surveys (for example, to manage and improve the recruitment process).
  4. Application analysis such as verification of your employment reference(s) that you have provided, background checks and related assessments.
  5. Compliance with corporate governance and legal requirements (for example, to monitor diversity requirements).
  6. Communicate with you and to inform you of current status of your application and future opportunities (unless you have told us that you do not want us to keep your information for such purposes).
  7. Assessing your skills, qualifications and interests against our career opportunities.
  8. Verifying your information and carrying out reference checks and/or conducting background checks (where applicable) if you are offered a job.
  9. Communications with you about the recruitment process and/or your application(s), including, in appropriate cases, informing you of other potential career opportunities at Nobel.
  10. Creating and/or submitting reports as required under any local laws and/or regulations, where applicable.
  11. Where requested by you, assisting you with obtaining an immigration visa or work permit where required.
  12. Making improvements to Nobel’s application and/or recruitment process including improving diversity in recruitment practices.
  13. Complying with applicable laws, regulations, legal processes or enforceable governmental requests; and/or
  14. Proactively conducting research about your educational and professional background and skills and contacting you if we think you would be suitable for a role with us.

We may collect your data in three main ways:

  • directly from you, by sending your job applications and / or CVs on our Sites, our fax / e-mail or by sending them to our headquarters or to the agencies the human resources we collaborate with;
  • indirectly, from other sources / third parties (e.g., requests submitted to human resources agencies); and
  • automatic collection (e.g., through cookies or profile creation).

We collect your data directly from you through: – entering your data or your job application or CV on our Site or through an application form, as part of the registration process; – sending or interviewing your job application or CV to a Nobel consultant by e-mail; – applying for a job through a job aggregator, which then redirects you to the Nobel site.

We may collect your data from other sources: – social media channels; – recruitment service providers; – former employers, former colleagues or current employees of ours, when we receive direct recommendations about you.

We may collect your data automatically by: – cookies (we collect your data automatically through cookies when you visit our Site, in accordance with the cookie settings in your browser and the Cookie Policy included on the Site); – creating profiles using specific HR tools.

 

PROFILING AND AUTOMATED DECISION MAKING

Nobel may also process your personal data in relation to your application for data and statistical analysis. We may deploy specific technologies for the purposes of enabling certain global-level recruiting analysis and diversity monitoring with your consent were permitted by applicable law, to comply with legal requirements or in Nobel’s legitimate interests. Nobel does not make any automated decisions in relation to your application without human involvement. We will also use your information to protect the rights and property of Nobel, our users, applicants, candidates, employees or the public as required or permitted by law. If you are offered and accept employment with Nobel, the information collected during the application and recruitment process will become part of your employment record.

 

WITH WHOM WILL NOBEL SHARE YOUR PERSONAL INFORMATION?

We take care to share your personal information only with those who really need it in order to perform their tasks and duties, and to third parties with a legitimate business need. Because of their functions and within the limits of their respective attributions, the data collected are intended for to authorized internal departments within Nobel, the service provider(s) in charge who process the data according to Nobel’s instructions or, in accordance with the laws and regulations in force, the data may be transmitted to the competent authorities, at their request (local labor authorities, courts and tribunals, regulatory bodies and/or law enforcement agencies for the purpose of complying with applicable laws and regulations, or in response to legal process). Your information may be shared with our affiliates, subsidiaries, in relation to the purposes described above.

We will also share your personal information with other third parties to detect, prevent or otherwise address fraud, security or technical issues, or to protect against harm to the rights, property or safety of Nobel, our users, applicants, candidates, employees or the public or as otherwise required by law. It is your responsibility to obtain consent from referees before providing their personal information to Nobel.

We operate globally, which means your information may be stored and processed outside of the country or region where it was originally collected including in the United States. In some of these countries, you may have fewer rights in respect of your information than you do in your country of residence. Regardless of where your information is processed, we apply the same protections described in this Privacy Policy. We also comply with certain legal frameworks relating to the transfer of data, such as the european frameworks described below. The European Commission has determined that certain countries outside of the European Economic Area (EEA) adequately protect personal data. You can review current European Commission adequacy decisions on the Commission website. To transfer data from the EEA to other countries, such as the United States, we comply with legal frameworks that establish an equivalent level of protection with EU law. The European Commission has approved the use of model contract clauses as a means of ensuring adequate protection when transferring data outside of the EEA. By incorporating model contract clauses into a contract established between the parties transferring data, personal data is considered protected when transferred outside the EEA or the UK to countries which are not covered by an adequacy decision. We rely on these model contract clauses for data transfers.

Third party service providers. We may also share your personal information with third parties who provide services to us such as recruitment agencies, consultants, background services and attorneys. If your personal information is shared in this way, Nobel do so only on a “need-to-know” basis and we will seek to ensure it is only used in connection with the functions or services these parties will be performing for Nobel and that your personal information is treated by them in a confidential manner. These service providers that Nobel uses may change depending on the Nobel entity that employs you and may change over time but we will always seek to ensure that any third parties who handle your personal information will do so in a manner consistent with this Privacy Policy and in accordance with applicable law.

Other third parties. We may also share your personal information with third parties:

  1. As necessary to comply with our legal obligations, including in order to respond to a lawful government request, court order, administrative or judicial process (such as a subpoena or search warrant).
  2. As necessary to establish, exercise or defend our legal rights.
  3. As necessary to protect your vital interests (for example, we may need to share your personal information with third parties in the event of an emergency).
  4. Where we have otherwise obtained your consent.

 

LEGAL BASIS UNDER WHICH NOBEL PROCESSES YOUR PERSONAL INFORMATION

Our legal basis for our collecting and processing of your personal information is as follows:

  1. Nobel’s legitimate interests, namely the recruitment, selection, evaluation and appointment of new employees and the management and administration of the recruitment and HR process, to the extent these activities do not prejudice or harm your rights and freedoms. In each circumstance in which we will base the processing of your personal data on our legitimate interest we will ensure that we take into account your interests and fundamental rights and freedoms, so that the processing of personal data is not excessive or in any way. contrary to the applicable legal provisions.
  2. Compliance with Nobel’s legal obligations where employment law or other laws require the processing of your personal information (for example to the extent the law requires the monitoring equality of opportunity and diversity).
  3. Other legal grounds where applicable such as in your vital interests (for example, health and safety reasons if you attend an interview at our site) and agreements with employee representations.
  4. In order to conclude the individual employment contract with you (a. in order to evaluate your compatibility with the job requirements available within Nobel; b. in order to verify some or all of the information included by you in the job application submitted; c. in order to ensure communication with you during the discussions and in general to ensure that our relationship can function without problems.
  5. Your agreement. If we request your consent to process your data because there is a legal requirement to do so, according to the applicable law, you can withdraw your consent later, at any time, by a written notification to the Human Resources Department, to the attention of the Manager of the Human Resources Department. If you withdraw your consent, this will not affect: (i) the processing of your personal data that we have already performed; or (ii) the processing that is not based on your consent. HOW LONG WE KEEP YOUR PERSONAL INFORMATION

We will keep your personal information for as long as necessary in connection with the purposes described in this Privacy Policy and in accordance with Nobel’s retention policy and applicable law.

No excess data. Nobel limits the processing of your personal data to data that is reasonably adequate and relevant to the purposes described in this Privacy Policy. We take reasonable steps to delete all data that is not required for applicable purposes.

Data retention period. We will keep your data for the period necessary to evaluate your application, taking into account, among other things, the need to contact you, for the period necessary to answer questions received from you, for the period necessary to solve or perform certain formalities or in general in order to fulfill the purposes. We also need your data to the extent that we reasonably consider it necessary to fulfill our applicable legal obligations.

Subject to any legal requirements for the retention of your data, we may retain and retain your data for a limited period of up to 36 months after discussions between us regarding your job application cease. During this period, we will contact you if we consider that other jobs that have become available in Nobel would be compatible with you. Data quality. We make all reasonable efforts to ensure that the data we hold is accurate, complete and up to date. Please let us know if any of this data changes or if, during our discussions, you notice any errors regarding this data to allow us to rectify it. You can also update your data by submitting additional information to the person within the Nobel you have been in contact with or through the Human Resources Department at hr@nobelglobe.com.

However, your personal data are kept for the length of time necessary for meeting the legal and /or contractual obligations undertaken by Nobel. The duration of data storage could depend thus on their nature (e.g., for the duration of the contract plus a specific period for any particular situation, if it is necessary, after its termination). When the law requires, Nobel will save certain information for the period necessary in order to comply with applicable legal and regulatory provisions, in the context of our activities.

 

INTERNATIONAL TRANSFER

We process your personal information in the local country where you submitted your application and through our global recruitment platform. This will involve transferring your personal information, including personal information collected. Nobel may host these servers or utilize third party service providers, but in either case we will be responsible for the secure access of personal information.

We may transfer your personal information to other companies within Nobel which are outside your country of residence (and which may have a different level of data protection to your home country for the purposes described in this Privacy Policy. In order to provide adequate protection of your personal information, we have in place contractual arrangements (where appropriate) with our group companies which cover these transfers and we will take all reasonable measures to safeguard your information whenever it is transferred.

 

WHY DOES NOBEL PROCESS YOUR PERSONAL DATA COLLECTED? 

On our Site, you can view open positions, apply to jobs and get information on Nobel and our recruitment process. We collect and treat your personal data in conformity with the GDPR and other laws and regulations that may be applicable in order to provide you with quality services while respecting your rights and liberties. Nobel ensures that your data is treated securely and confidentially, including when certain operations are carried out by subcontractors. YOUR RIGHTS

In certain countries, you may have certain rights under data protection law. This may include the right to request access or to update or review your information.   1. Access: you have the right to request information about how we process your personal data and obtain a copy of that personal data;
  2. Rectification: you have the right to request the rectification of inaccurate personal information about you and for any incomplete personal information about you to be completed;

Nobel does not, as part of its recruitment process, make solely automated decisions about candidates;
  6. Restriction: you have the right to ask us to restrict our processing of your personal information, so that we no longer process that information until the restriction is lifted;
  7. Portability: you have the right to receive your personal information, which you have provided to us, in a structured, commonly used and machine-readable format and to have that information transmitted to another controller in certain circumstances.

 

HOW DO YOU EXERCISE YOUR RIGHTS?

You may exercise your rights of access and rectification of your personal data at any time. A right of deletion, a right of limitation or a right of opposition may also be exercised. In some cases, the portability of your data is possible. Where the processing of personal data is based on your consent, we inform you that you may withdraw this consent at any time. You can issue instructions on the storage, deletion or disclosure of your personal data after your death. You are informed that you have the right to make a request to the supervisory authority in charge of compliance with personal data obligations from your country. YOUR DUTIES

You are responsible for the information you provide to Nobel and that it is honest, truthful, accurate and not misleading in any way. If you provide information concerning any other person such as individuals you provide as references, you are responsible for providing any notices and ensuring your referee consents to Nobel collecting and processing that information as described in this Privacy Policy.

Subject to express request and proof of their identity to Nobel, when necessary, you have the right to access, rectify and delete your personal data, as well as the right to oppose or limit the processing of your personal data, by contacting Nobel. You also have the right to portability of their personal data as well as to provide Nobel with directives related to treatment of your data after your death. Otherwise, once you have given consent as to a particular form of treatment, you still have the right to rescind consent at any moment. In case of exercise of the right of opposition, Nobel would cease all treatment of personal data, except for legitimate reasons imperative to such treatment, or to ensure the observation, exercise or the defense of our rights in court in accordance with applicable regulations.

 

HOW CAN YOU EXERCISE YOUR RIGHTS RELATED TO YOUR PERSONAL DATA?

You will receive a response within a maximum delay of one month, with it understood that a response could take longer, depending on the complexity of the request and number of requests to be processed in the same time. You will therefore be informed within one month of receipt of your request of any prolongation and the reasons for it.

 

MODIFICATION TO THE PRIVACY POLICY

We will only use your personal information in the manner described in this Privacy Policy. We are likely to modify this Privacy Policy from time to time in order to reflect changes in our policies, to clarify our practices or to continue to meet regulations. However, we reserve the right to change the terms of this Privacy Policy at any time by posting revisions to our Site.
